As set out in the Order, Plaintiff's claims for direct negligence against Oak Truck Lines, LLC contained in Count 2 of Plaintiff's Complaint are moot as a matter of law and are therefore dismissed without prejudice. Plaintiff's claims for punitive damages contained in Sections IV and VI of Plaintiff's Complaint are dismissed without prejudice. Plaintiff's remaining allegations against Oak Truck Lines, LLC on the basis of vicarious liability contained in Count 1 and any vicarious-liability claims referenced in Count 2 of Plaintiff's Complaint are not dismissed and shall continue.
