IT IS FURTHERE ORDERED that the Clerk of Court is directed to open a new civil action in the Northern Division of this Court under Bivens, with Passmore's Petition #1 serving as the initiating Complaint, a copy of Passmores Memorandum in Support #2 , and Passmore's Response #4 that includes his exhaustion of the BOP's administrative remedies in the new Bivens civil action.
