The Court finds that Petitioner fails to meet the exhaustion requirement of the available administrative remedy program of the BOP and he also fails to establish that there exist extraordinary circumstances excusing such exha ustion requirements. Therefore, because the Petitioner has failed to utilize the administrative remedy process available to him, this action will be dismissed without prejudice for the Petitioner's failure to exhaust his administrative remedies within the BOP as set forth in 28 C.F.R. § 542.
