ORDER SEVERING HABEAS CLAIMS- IT IS, THEREFORE, ORDERED AND ADJUDGED that McCoys habeas claims are SEVERED from this 1983 civil action. Since McCoys conviction and sentence was imposed by the Circuit Court for Lincoln County, Mississippi, the Clerk of Court shall open a new civil action under 28 U.S.C. 2254 in the Western Division on McCoys habeas claims with Commissioner Burl Cain as the named Respondent, and therein file a copy of the Complaint #1 , a copy of page one of McCoys Attachment #5 , a copy of McCoys completed Motion #4 for Leave to Proceed in forma pauperis, and a copy of this Order.
