Peebles Harrison, Esq.; Court Reporter/FTR #: 9:03:34 - 9:21:07; Time of Hearing: 9:00am; Courtroom: 3B; The Court set this matter for hearing after reviewing counsels' Proposed Discovery Plan/Scheduling Order #123 , and hears from counsel as to how the District Judge's recent orders will affect both discovery and Plaintiff moving for conditional certification of class. Counsel have not yet conducted a formal Rule 26(f) conference, and the Court instructs them to prepare to conduct one forthwith. After hearing additional representations of counsel concerning their positions on discovery, The Court informs counsel that it is not inclined to bifurcate discovery. IT IS ORDERED: Counsel shall conduct a meaningful Rule 26(f) conference within the next 15 days. Counsel should address electronically stored information, any need for a protective order governing confidentiality, and the electronic format in which the documents are maintained and how they will be produced. Counsel will also complete their initial disclosures within this 15 day period. Counsel shall further propound initial discovery, as well as discuss representative discovery, operating under the assumption that a class will be certified and that it will be limited to the State of Nevada. Plaintiffs' counsel shall initiate any discovery that is deemed necessary related to the District Judge's orders as directed in open court. IT IS FURTHER ORDERED:Status Hearing set for 3/09/10 @ 9:30am in Courtroom #3B before U.S. Magistrate Judge Peggy Leen. A Joint Status Report shall be due no later that 3/05/10. The Court will enter a Discovery Plan and Scheduling Order at the next hearing, and is inclined to give the parties 180 days to complete discovery. The Court further urges Plaintiffs' counsel to begin speaking to potential experts to ascertain what they may need in an effort to expedite this process.
