Villani, Doe Assistant Clark County District Attorneys and the State of Nevada be dismissed with prejudice due to Plaintiff's failure to state a claim upon which relief may be gr anted. It is further recommended that Defendant Michael P. Villani's 3 MOTION to Dismiss be dismissed as moot. Objections to R&R due by 11/15/2009. IT IS HEREBY ORDERED that Plaintiffs Application to Proceed In Forma Pauperis 1 is granted. The Clerk of the Court shall file the Complaint. Plaintiffs Motion to Amend the Complaint 7 is granted. The Clerk of the Court shall file the Amended Complaint 7 . Plaintiffs Amended Complaint 7 shall be dismissed without prejudice for fai lure to state a claim upon which relief can be granted, with leave to amend. Plaintiff shall have thirty (30) days from the date of the entry of this Order to file his Second Amended Complaint, if he believes he can correct the noted deficiencies. F ailure to comply with this Order will result in the dismissal of this action. Plaintiffs Motion for Early Case Conference and Scheduling Order 2 is denied. Plaintiffs Motion to Extend Time to Respond to Defendants Motion to Dismiss 5 is denied as moot. Plaintiffs Motion for a Court-Ordered Grand Jury 8 and Defendants Motion to Strike 9 are denied.
