ORDERED that 25 Motion for Leave to File Pleading in Excess of Thirty Pages is GRANTED. FURTHER ORDERED that Ground 17 and Ground 41 are DISMISSED WITH PREJUDICE AS CONCLUSORY. FURTHER ORDERED that the Petition for Writ of Habeas Corpus is GRANTED as to Ground 8 and is DENIED as to the remaining grounds, including Ground 41, which are meritless. The conviction for Assault with the Use of a Deadly Weapon is hereby OVERTURNED and the sentence is hereby VACATED. The matter is remanded to the Eig hth Judicial District Court for the sole purpose of entering a Second Amended Judgment of Conviction evidencing conviction and sentences only as to Counts II, Robbery and the Use of a Deadly Weapon, and Count III, Larceny From the Person.
