October 20, 2010	Filing 53 ORDER that Defendants Motion to Extend Discovery 44 is GRANTED to the extent that the parties shall have an extension to complete the depositions of Ernie Shore and Rick Brown which both sides agree need to be taken. Additionally, Defendant shall have an extension to take the depositions of David and Eskander Ghermezian provided the Canadian court grants leave pursuant to the letters rogatory process. Plaintiffs Motion to Strike 41 is GRANTED in part and DENIED in part. The Motion is GRANTE D to the extent Defendant shall be precluded from calling the expert to provide legal opinion testimony. The motion is DENIED to the extent the trial court finds the lease and amended lease agreements are ambiguous and extrinsic or parol evidence on industry practice, custom or usage would be helpful.
