Since the motion to dismiss hasn't been determined, the complaint as it is without counterclaims, can't be plead yet. On the discovery that can now proceed on the complaint as it has been plead, IT IS ORDERED that the parties shall submit a discovery plan and scheduling order by this Friday, 6/28/13, on those. The counterclaims will be addressed when those become at issue. There may not be an agreement on the number of depositions, therefore, IT IS FURTHER ORDERED that counsel shall come to an agreement on anything that can be agreed to.
