It is ordered that the jury trial is set for 10/24/2017 at 9:00 AM in Las Vegas courtroom 4B. The Court asks that counsel be in the courtroom at least 15 minutes early on 10/24/2017 to resolve any last minute items. On subsequent days thereafter, the trial will be held from 8:30 AM to 4:30 PM or 5:00 PM. The Court will conduct voir dire, utilizing some of the questions proposed by counsel. 8 jurors will be selected to try the case. The Court will allow sidebars to discuss whether jurors should be excused for cause or whether additional questions should be posed to the proposed jurors. Counsel are to be prepared to present opening statements right after the jury is empaneled and to have witnesses standing by to testify. If they intend to use PowerPoint or demonstrative items during opening statements, they must share the items with opposing counsel and be prepared to discuss any objections to those items before the proposed jury enters the courtroom on 10/24/2017. The Court encourages counsel to schedule witnesses so that Court does not have to recess due to witness unavailability. The Court uses its own preliminary jury instructions. Those instructions can be found on the Courts website at #www.nvd.uscourts.gov The Court discusses the submission of proposed jury instructions, including the method of submitting disputed instructions. The Court will resolve final jury instructions on Tuesday, 10/24/2017 or Wednesday, 10/25/2017, after the jury leaves for the day. Mr. Martin advises the Court that he and Ms. Petrelli have been working on jury instructions. Mr. Martin advises the Court that Plaintiff will call Fords 30(b)(6) custodian of records as a witness. Mr. Crawford will not accept the subpoena for Fords 30(b)(6) witness, who resides in Michigan. Counsel will submit briefs today on this issue. The Court advises counsel that it will issue an oral ruling on the three pending motions in limine. The Court has reviewed Defendant's motion in limine to exclude reference to customer satisfaction program 13B04 (MIL #1) (ECF No. #57 ,) Defendant's motion in limine to exclude evidence of other incidents (MIL No. 2,) (ECF No. #58 ,) and Defendant's motion in limine to exclude reference to customer satisfaction program 13B04 as a recall (MIL #3) (ECF No. #59 .) Plaintiff filed a consolidated response (ECF No. #64 ) to ECF Nos. #57 and #59 .
