The Court makes preliminary statements and hears representations of counsel regarding #123 Second Motion for Modification of Asset Freeze. For the reasons stated on the record at this hearing, IT IS ORDERED that the #123 Motion is GRANTED IN PART and DENIED IN PART. IT IS FURTHER ORDERED that the Receiver shall disburse $1,500 per month to Jason and Danelle Miller for living and personal expenses, to be continued on the monthly payment schedule that is currently being followed. The first disbursement made under this order shall occur on April 1, 2014. These disbursements are subject to the same requirements to keep records of all purchases made as described in the Courts previous #77 Order of December 4, 2014.IT IS FURTHER ORDERED that the Millers shall submit the required documentation to the Receiver by the 25th day of each month that this order is in effect. The Receiver shall file a status report with the Court by the 30th of each month, at which time it may issue the next disbursement if the Millers have satisfied and submitted the required documentation.IT IS FURTHER ORDERED that the Receiver shall have the authority to make direct bill payments for the following expenses only: (1) child support on behalf of Jason Miller and (2) monthly premium payments for the Millers' health insurance plan purchased through Anthem Blue Cross. The Receiver shall make these bill payments using the same methods as described in the Court's previous #77 Order of December 4, 2014 and shall do so on a monthly basis when it determines that it has sufficient proof from the Millers that the expenses are due. IT IS FURTHER ORDERED that the disbursements for personal expenses and authorization for the Receiver to make payments for child support and health insurance will be in effect beginning on April 1, 2015 and ending on June 30, 2015. IT IS FURTHER ORDERED that the Court does not authorize the expenditure of any receivership funds as payment for counsel for the corporate defendants at this time. The Receiver shall submit its position with respect to whether or not the Court should authorize such an expenditure by April 6, 2015. The Court will issue a written order along with this order so the Receiver will have a written order for the purposes of carrying out its functions.
