FURTHER ORDERED that under 28 U.S.C. § 1915(b), the Nevada Department of Corrections must pay to the Clerk of the United States District Court, District of N evada, 20% of the preceding months deposits to the account of Plaintiff Rigoberto Enrique Isaza, #1134484, in the months that the account exceeds $10.00, until the $350.00 filing fee has been paid for this case. The Clerk of Court must send a copy of this order to the attention of Albert G. Peralta, Chief of Inmate Services. The Clerk shall file the complaint. FURTHER ORDERED that Plaintiff's complaint is DISMISSED without prejudice for failure to state a claim, with leave t o amend. Plaintiffs deadline for filing his amended complaint is March 20, 2017. FURTHER ORDERED that the Clerk of Court must send to Plaintiff the approved form for filing a § 1983 complaint, instructions for the same, and a copy of his original complaint.
