ORDER DISMISSING CASE Without Prejudice. IT IS THEREFORE ORDERED that 1 application to proceed in forma pauperis is DENIED and that this action is DISMISSED WITHOUT PREJUDICE. IT IS FURTHER ORDERED that all pending motions are DENIED without p rejudice. IT IS FURTHER ORDERED that the clerk of court shall send petitioner two copies each of an application form to proceed in forma pauperis for incarcerated persons and a noncapital section 2254 habeas petition form, one copy of the instructi ons for each form. IT IS FURTHER ORDERED that petitioner may file a new petition and in forma pauperis application in a new action, but he may not file further documents in this action. IT IS FURTHER ORDERED that the clerk of the court shall enter judgment accordingly. IT IS FURTHER ORDERED that a certificate of appealability is DENIED. Signed by Judge James C. Mahan on 6/10/15.
