I further order the Clerk of the Court to file this order and a copy of the first amended complaint (ECF No. 1-2) in the new case. I further order the Clerk of the Court to note that the filing fee in the new case is administratively waived because the new case is severed from this removed case. Count I is dismissed without prejudice with leave to amend. Count II, alleging free exercise of religion and equal protection claims, will proceed against defendant Calderin. If Plaintiff Salazar chooses to file a second amended complaint curing the deficiencies of his FAC as outlined in this order, he will do so by 11/27/2019. See Order for Details.
