| Filing 63 MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Brenda Weksler on 1/15/2021. Before the Court are three motions filed by various defendants. ECF Nos. #46 , #50 , and #51 . In the District of Nevada, the Local Rules provide that the deadline to file a response to any motion (except for a motion for summary judgment) is 14 days after service of the motion. LR 7-2(b). Here, the deadline for plaintiff to file responses to ECF Nos. #46 , #50 , and #51 lapsed on January 5, 6, and 7, 2021, respectively. Plaintiff did not file responses and nor has he sought an extension of time to do so. Under the Local Rules, "[t]he failure of an opposing party to file points and authorities in response to any motion, except a motion under Fed. R. Civ. P. 56 or a motion for attorney's fees, constitutes a consent to the granting of the motion." LR 7-2(d). Here, the Court construes plaintiff's nonresponse to ECF Nos. #46 , #50 , and #51 as his consent to the granting of the motions. IT IS THEREFORE ORDERED that the motions at ECF Nos. #46 , #50 , and #51 are GRANTED. As a result, IT IS FURTHER ORDERED that discovery between plaintiff and defendants The National Basketball Association, The Los Angeles Lakers, Mitchell Silberberg & Knupp, LLP, and City of Walnut, California, is STAYED until after the district judge resolves the defendants' motions to dismiss. IT IS FURTHER ORDERED that the parties' proposed discovery plan and scheduling order is due 21 days after the district judge resolves all the pending motions to dismiss, to the extent this matter is not dismissed with prejudice.Finally, IT IS ORDERED that the Clerk of Court is kindly directed to send plaintiff a copy of this minute order.
