Before the Court is Defendant Clark County School District's ("CCSD's") #1 Petition for Removal. The #1 Petition alleges that this Court has subject matter jurisdiction over the case because "the first, second and third causes of action allege violation of the Individuals with Disabilities Education Act against all Defendants." (Pet. Removal 2:14-19, ECF No. #1 ). However, the appended Complaint only asserts two causes of action---for negligence and negligent infliction of emotional distress---both of which arise under state law. Accordingly, IT IS HEREBY ORDERED that CCSD shall show cause why the Court should not remand this action to Clark County District Court for lack of subject-matter jurisdiction. CCSD shall file a brief, not to exceed ten pages, demonstrating that the Court has subject-matter jurisdiction over the action by December 23, 2020. Failure to comply with this Order will result in this case being remanded to Clark County District Court. Additionally, if Plaintiff wishes to address the jurisdictional issues implicated by this Order, she shall have until December 23, 2020, to file a brief, not to exceed ten pages, discussing the issues raised herein.(Copies have been distributed pursuant to the NEF - DZ)
