Pending before the Court is Respondent NP Red Rock LLC's ("Respondent's") Emergency Motion to Extend Time, (ECF No. #14 ). On December 30, 2020, the Court entered a 8 Minute Order granting in part Petitioner Cornele A. Overstreet's ("Petitioner's") #4 Motion to Shorten Time, Expedite Pleadings, and Set Hearing, which ordered a Response to the #1 Petition for Temporary Injunction by January 8, 2021. Respondent's present Emergency Motion requests an extension to January 22, 2021, to file its Response. (Mot. Ext. Time 1:20-24, ECF No. #14 ). Respondent explains the extension is warranted because Petitioner filed this Motion during the holidays in bad faith despite being able to bring the Motion a month prior; attorneys needed to assist in the Response are presently unavailable; and Petitioner submitted new materials not in the administrative record that necessitate more time to review to adequately respond. (Id. 3:16-4:26). Upon further review of Petitioner's #4 Motion to Shorten Time that the Court previously granted, the Court finds that Petitioner has explained the need for an expedited decision regarding the Petition, but not an imminent risk of harm that necessitates expedited briefing. Accordingly, IT IS HEREBY ORDERED that the Court GRANTS Respondent's #14 Emergency Motion to Extend Time.
