Pending before the Court are the #7 and #26 Motions to Dismiss filed by Defendants Care Improvement Plus Group Management, LLC; Health Plan of Nevada, Inc.; Sierra Health and Life Insurance Company, Inc.; UMR, Inc.; and Culinary Health Fund Administrative Services, LLC (collectively, "Defendants"). On April 22, 2021, the Court granted counsel's #41 Motion to Withdraw as Attorney for Plaintiff Medarc, LLC ("Plaintiff"). (See Order, ECF No. #46 ). The parties stipulated that the response deadline for both the #7 and #26 Motions would be extended until "two weeks after Plaintiff has retained new counsel, or by April 30, 2021, whichever is sooner." (See Stipulations for Extension of Time, ECF Nos. #42 , #44 ). Plaintiff was originally ordered to file a Notice of Appearance by new counsel no later than May 20, 2021, and the Court granted an extension of that deadline until June 10, 2021. (See Orders, ECF Nos. #46 , #48 ). To date, Plaintiff has neither filed a Notice of Appearance, nor responded to the Motions to Dismiss, and the deadlines to do so have passed. Accordingly, pursuant to this District's Local Rule 7-2(d), IT IS HEREBY ORDERED that the #7 and #26 Motions to Dismiss are GRANTED. (Copies have been distributed pursuant to the NEF - KB) |
