June 11, 2021 Filing 18 MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Brenda Weksler on 6/11/2021. At ECF No. #17 defendant Sean Ferren filed his Rule 26 initial and pretrial disclosures. The Federal Rules of Civil Procedure provide that "disclosures under Rule 26(a)(1) or (2)... must not be filed until they are used in the proceeding or the court orders filing." Fed. R. Civ. P. 5(d)(1)(A). The Local Rules similarly provide that "the documents listed in Fed. R. Civ. P. 5(d)(1)(A)"--which include disclosures under Rule 26(a)(1) and (2)--"must not be filed with the court until they are used the proceeding, unless the Court orders otherwise." LR 26-7.Here, Ferren's filing violates LR 26-7 because his Rule 26 disclosures are not being used in the proceeding within the meaning of the rules (e.g., in connection with a motion) and the Court did not order their filing. The Court "may strike any document that does not conform to an applicable provision of [the Local Rules] or any Federal Rule of Civil... Procedure." LR IA 10-1(d).
