June 3, 2021 Filing 15 MINUTE ORDER IN CHAMBERS of the Honorable Judge Gloria M. Navarro on 6/3/2021. Pending before the Court is Defendant Paysign, Inc.'s ("Defendant's") #1 Petition for Removal. Defendant alleges that the Court has federal question jurisdiction over the case because Plaintiff "inartfully" alleges claims under the Americans with Disabilities Act. (See Pet. Removal at 2). However, the state court complaint alleges only state law claims: intentional infliction of emotional distress and negligence. (See Compl., Ex. 2 to Pet. Removal). Federal question jurisdiction only extends to cases that allege federal claims on their face, and a plaintiff may "avoid federal jurisdiction by exclusive reliance on state law" when pleading his causes of action. Caterpillar, Inc. v. Williams, 482 U.S. 386, 392 (1987). Accordingly, IT IS HEREBY ORDERED that by June 16, 2021, Defendant shall file a brief, not to exceed five (5) pages, explaining why the case should not be remanded to Clark County District Court.
