July 21, 2021 Opinion or Order Filing 16 MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 7/21/2021. IT IS HEREBY ORDERED that a ruling on Verified Petition for Permission to Practice Pro Hac Vice and Designation of Local Counsel #13 & #14 are DEFERRED. IT IS FURTHER ORDERED that Petitioner's Brent S. Moffett and Stephen T. Moffett shall provide a current Certificate of Good Standing from EACH state in which Petitioner has been admitted to practice law, in accordance with the instruction set forth on Page 2, No. 3 of the Verified Petition For Permission To Practice In This Case Only By Attorney Not Admitted To The Bar Of This Court And Designation Of Local Counsel. July 21, 2021 Opinion or Order Filing 15 MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Brenda Weksler on 7/21/2021. Before the Court is the parties' "joint case management report," which the Court construes as the parties' proposed discovery plan and scheduling order. ECF No. #12 . The proposed DPSO violates the Local Rules in several respects, so it is DENIED. First, the proposed DPSO violates LR 26-1(a) because it does not indicate on its face whether it is submitted in compliance with LR 26-1(b) or whether special scheduling review is requested. Second, the deadlines proposed by the parties appear to deviate from the standard 180-day discovery period (e.g., the expert deposition deadline will not expire until July 2022) but the parties did not provide "a statement of the reasons why longer or different time periods should apply to this case." LR 26-1(a). Third, the proposed schedule permits expert disclosures after the close of fact discovery, which is a deviation from LR 26-1(b)(3), but the parties do not explain or justify this decision either. Fourth, the proposed DPSO violates LR 26-1(b)(10) because it lacks a signature block for the judge's signature. IT IS ORDERED that a new proposed DPSO is due 7/30/2021.
