September 16, 2021 Opinion or Order Filing 7 MINUTE ORDER IN CHAMBERS of the Honorable Judge Gloria M. Navarro on 9/16/2021. Plaintiff Liberty Insurance Company's ("Plaintiff's") #5 Complaint does not allege whether this Court's subject matter jurisdiction arises under diversity of citizenship or federal question. If the Court's jurisdiction arises in diversity, Plaintiff has not alleged the amount in controversy, nor has it alleged its principal place of business. Plaintiff alleges that the Court may issue a declaratory judgment under 28 U.S.C. 2201(a), but the Declaratory Judgment Act does not provide a basis for federal subject matter jurisdiction. Allen v. Milas, 896 F.3d 1094, 1099 ("The Declaratory Judgment Act does not confer subject matter jurisdiction."). Accordingly, IT IS HEREBY ORDERED that Plaintiff shall file a Notice explaining this Court's subject matter jurisdiction by September 30, 2021.
