| Filing 12 MINUTE ORDER IN CHAMBERS of the Honorable Judge Gloria M. Navarro on 10/13/2021. IT IS HEREBY ORDERED that Defendant Marten Transport, LTD., and Defendant Bir B. Mongar (collectively, "Defendants") show cause as to why the Court should not remand this action to Eighth Judicial District Court for failure to satisfy the diversity jurisdiction requirements set forth in 28 U.S.C. 1332. Specifically, Defendants must show that the amount in controversy exceeds $75,000.00. The Complaint, which Defendants refer to, broadly alleges damages in excess of $10,000.00 plus future treatment, lost wages, and lost use of the vehicle. (See Compl. at 2, Ex. A to Pet. Removal, ECF No. #1 ). Accordingly, Defendants shall have until October 29, 2021 to file a brief, not to exceed ten pages, demonstrating that the Court has subject matter jurisdiction over this action. Failure to comply with this Order will result in this case being remanded to Eighth Judicial District Court. (Copies have been distributed pursuant to the NEF - NY) |
