IT IS HEREBY ORDERED that Plaintiff Rodney Mott ("Plaintiff") show cause as to why the Court should not remand this action to the Eighth Judicial District Court for failure to satisfy the diversity jurisdiction requirements set forth in 28 U.S.C. 1332. Plaintiff, Defendant Hutchinson & Steffens, LLC, and Defendant Michael Brooks are alleged citizens of Nevada. (See Compl. 3:22-23, ECF No. #1 ). Furthermore, Plaintiff broadly asserts that the amount of damages exceeds $75,000.00; however, fails to provide any supporting authority. (See id. 3:23). Accordingly, Plaintiff must demonstrate that the complete diversity requirement and amount in controversy requirement of 28 U.S.C. 1332(a)(1) are satisfied in this case. Plaintiff shall have until November 17, 2021 to file a brief, not to exceed ten pages, demonstrating that the Court has subject matter jurisdiction over this action. Failure to comply with this Order will result in this case being remanded to the Eighth Judicial District Court.(Copies have been distributed pursuant to the NEF - NY) |
