Having reviewed Plaintiff and American Homes 4 Rent's (AH4R) stipulation, the Court finds that it is lacking an explanation of whether Defendant Boyd Gaming has joined in the stipulation or even whether Plaintiff and AH4R intended to serve Boyd Gaming. Under Local Rule 7-1 "[s]tipulations relating to proceedings before the court... must be in writing and signed by all parties who have appeared or their attorneys." LR 7-1(a). "A stipulation that has been signed by fewer than all the parties or their attorneys will be treated -- and must be filed -- as a joint motion." LR 7-1(c). IT IS THEREFORE ORDERED that the stipulation to stay discovery (ECF No. 15) is DENIED without prejudice. The parties must either re-file their stipulation signed by all parties who have appeared or file it as a joint motion. In the interest of including a definitive time frame on the docket, the parties are also directed to include a proposed deadline for the stay in their renewed filing.
