February 22, 2023 Opinion or Order Filing 65 MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Daniel J. Albregts on 2/22/2023. Re: #64 Motion to extend expert discovery deadlines and to sanction Laughlin Watercraft Rentals on order shortening time. Plaintiffs' motion has a number of deficiencies that prevent the Court from deciding it. First, Plaintiffs' motion should have been filed as two motions. Under Local Rule IC 2-2(b), "[f]or each type of relief requested or purpose of the document, a separate document must be filed and a separate event must be selected for that document...[for example] separate documents must be filed for a motion to dismiss and a motion to sever, rather than filing a motion to dismiss and to sever in one document." Second, Plaintiffs have not given adequate reasons other than the pending expert discovery deadline to justify an order shortening time. But the Court considers the request to extend the expert discovery deadline to be procedural relief which does not constitute a good reason to shorten time. See LR 7-4(b). Finally, the Court considers Plaintiffs' motions to be discovery motions, for which the requirement to meet and confer under Local Rule 26-6 and Local Rule IA 1-3(f) apply. Although Plaintiffs assert that the parties met and conferred, the declaration their attorney submits only describes emails, which do not satisfy the requirement to meet and confer under LR IA 1-3(f). IT IS THEREFORE ORDERED that Plaintiffs' motion to extend the expert discovery deadlines and sanction Laughlin Watercraft Rentals on order shortening time #64 is DENIED WITHOUT PREJUDICE. January 30, 2023 Opinion or Order Filing 56 MINUTE ORDER IN CHAMBERS of the Honorable District Judge Anne R. Traum on 1/30/2023. On June 10, 2022, Laughlin Watercraft Rentals, LLC filed a Complaint for Exoneration from or Limitation of Liability pursuant to Rule F(1) of the Supplemental Rules for Admiralty or Maritime Claims and Asset Forfeiture Actions and 46 U.S.C. 30511 ("Laughlin's Complaint"). Rule F(1) requires that, "Not later than six months after receipt of a claim in writing, any vessel owner may file a complaint in the appropriate district court, as provided in subdivision (9) of this rule, for limitation of liability pursuant to statute." 46 U.S.C. 30511 states that, "The owner of a vessel may bring a civil action in a district court of the United States for limitation of liability under this chapter. The action must be brought within 6 months after a claimant gives the owner written notice of a claim." Before the Court is Laughlin's Application for Issuance of Monition and Injunction (ECF No. #39 ), which alleges compliance with Rule F(1) and requests the Court to issue notice to all persons asserting claims with respect to which the Complaint seeks limitation. Also before the Court is Plaintiffs' motion for summary judgment arguing that Laughlin's Complaint was untimely. The Court previously requested further briefing on the issue of timeliness. (ECF No. 48 .) Laughlin's responsive brief (ECF No. #53 ) did not provide sufficient information to resolve the issue of timeliness. On the record before it the Court is unable to conclude that Laughlin Watercraft Rentals LLC's Complaint for limitation of liability is timely. The Court requests that any further briefing related to the timeliness of Laughlin's Complaint address: (1) the tension between the statute's use of the term 'gives" and the Rule's use of the term "receipt" with respect to written notice of a claim; (2) principles of apparent authority as they relate to service upon the Registered Agent's wife; (3) whether the burden to establish timeliness is on Laughlin; and (4) whether further discovery has addressed or will address the precise timeline described in ECF No. 48 . Thus, the Court DENIES the Application for Issuance of Monition and Injunction (ECF No. #39 ) without prejudice. The Court is also of the view that further discovery and briefing may aid in its resolution of Plaintiffs' motion for summary judgment. At issue in Lynch's summary judgment motion (ECF No. #41 ) is whether Laughlin Watercraft Rentals, LLC ("LWR") filed a limitation-of-liability action more than six months after it was given notice of Estate of Tammy Lynch's ("Lynch") claims. The following facts appear to be undisputed: LWR failed to update the address of its registered agent as required by Nevada Law; After multiple attempts to serve LWR's registered agent at the address on file with the Secretary of State, Lynch located LWR's registered agent's actual address; Lynch provided a copy of the Summons and Complaint to LWR's registered agent's wife on December 7, 2021; LRW's insurer was notified of the claims on December 10, 2021; LWR filed its limitation-of-liability action June 10, 2022. LWR's responsive brief (ECF No. #42 ) does not identify at what point LWR's registered agent actually received written notice of Lynch's claim such that its insurer was provided with notice of Lynch's claim on December 10, 2021. The Court thus will give LWR an opportunity to supplement its briefing under FRCP 56(e)(1) such that it addresses the date its registered agent received written notice of Lynch's claim. Such briefing shall also address Lynch's argument regarding equitable estoppel set forth in its reply brief (ECF No. #47 ). LWR is directed to file its brief within 30 days of this Order.
