Filing 7 ORDER. IT IS THEREFORE ORDERED that a decision on the application to proceed in forma pauperis (ECF No. #1 ) is DEFERRED. IT IS ORDERED that the Fourteenth Amendment Due Process Clause claim for placement in administrative segregation CAN PROCEED against ONLY Ruiz; Nash is DISMISSED WITHOUT PREJUDICE from the complaint. IT IS ORDERED that that the motion for preliminary injunction (ECF No. #1 -2) is DENIED. IT IS ORDERED that, given the nature of the claim I have permitted to proceed, this action is stayed for 90 days to allow Reed and Ruiz an opportunity to settle their dispute before the $350 filing fee is paid, an answer is filed, or the discovery process begins; this case will be referred to to the court's Inmate Early Mediation Program, and a subsequent order will be entered. IT IS ORDERED that if the case does not settle, Reed will be required to pay the full $350 statutory filing fee for a civil action; if Reed is not allowed to proceed in forma pauperis, the full $350 statutory filing fee plus the $52 administrative filing fee, for a total of $402, will be due immediately. IT IS ORDERED that if any party seeks to have this case excluded from the inmate mediation program, that party will file a "motion to exclude case from mediation" no later than 21 days before the date set for mediation; if Reed needs a translator to participate in the mediation program, he will file a notice identifying the translation language and the need for the translator within 30 days of the entry of this order.IT IS ORDERED that the Attorney General's Office to advise the court within 21 days of the entry of this order whether it will enter a limited notice of appearance on behalf of Ruiz for the purpose of settlement; the Clerk of Court to file the complaint (ECF No. #1 -1 and send a courtesy copy to Reed; electronically serve a copy of complaint on the A.G.'s Office, and add A.G. to the docket sheet.
