August 11, 2022 Filing 4 MINUTE ORDER IN CHAMBERS of the Honorable Judge Gloria M. Navarro on 8/11/2022. On July 8, 2022, the Court ordered Plaintiff Ronald J. Allison ("Plaintiff") to show cause as to why the Court should not dismiss this action for failure to satisfy the diversity requirements set forth in 28 U.S.C. 1332. (See Order Show Cause, ECF No. 3 ). Plaintiff has not filed a response, and the deadline to do so has passed. (See id.) (setting an August 8, 2022, deadline to respond to the Order to Show Cause). The Court remains unconvinced that it has jurisdiction over this matter under 1332. Accordingly, IT IS HEREBY ORDERED that Plaintiff's Complaint, (ECF No. #1 -1), be DISMISSED without prejudice for lack of subject matter jurisdiction. July 18, 2022 Opinion or Order Filing 3 ORDER TO SHOW CAUSE. On July 13, 2022, Plaintiff Ronald J. Allison ("Plaintiff") filed the #1 -1 Complaint against Defendants All Casinos of Las Vegas ("Defendants"). After reviewing Plaintiff's #1 Complaint, the Court is unconvinced that it has subject matter jurisdiction over this matter. To have subject matter jurisdiction, that is, for the Court to be able to preside over this case, the opposing parties must be from different States. See 28 U.S.C. 1332. The Complaint does not state or include specific, factual allegations indicating the States of which Plaintiff and Defendants are citizens. (See generally Compl., ECF No. #1 -1). Accordingly, IT IS HEREBY ORDERED that Plaintiff show cause as to why the Court should not dismiss this action for failure to satisfy the jurisdictional requirements set forth in 28 U.S.C. 1332. Plaintiff shall have until August 8, 2022, to file a brief, not to exceed ten pages, addressing the Court's concern regarding the jurisdictional requirements under 1332. Failure to comply with this Order may result in this case being dismissed without prejudice. (Copies have been distributed pursuant to the NEF - EH)
