Filing 13 MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Daniel J. Albregts on 2/7/2023. Re: #12 Stipulated discovery plan. Having reviewed the parties' stipulated discovery plan, the Court finds that it contains a number of deficiencies. First, the discovery plan asserts that it is submitted in compliance with Local Rule 26-1(e). The parties have cited to the wrong section of the rule and are not submitting their plan in compliance with the correct rule. Under Local Rule 26-1(a), if the plan sets deadlines within those specified in Local Rule 26-1(b) - which sets out a discovery cutoff date of 180 days from the date the first defendant answered or otherwise appeared then the plan must state, in bold type "SUBMITTED IN COMPLIANCE WITH LR 26-1(b)." But the parties' plan seeks a discovery cutoff 240 days long and it is thus not in compliance with Local Rule 26-1(b). Second, the parties include an interim status report deadline. But the Local Rules no longer require an interim status report. Third, throughout the discovery plan, the parties cite to Local Rule 26-1(e) which is not in the current version of the Local Rules. Fourth, the parties cite to Local Rule 26-4 as governing extensions or modifications. But extensions and modifications are governed by Local Rule 26-3. Fifth, the parties do not make the certifications required by Local Rules 26-1(b)(8), and (b)(9). IT IS THEREFORE ORDERED that the parties' stipulated discovery plan #12 is DENIED. The parties are kindly directed to review and reference the most recent version of the Local Rules, in particular, Local Rule 26-1. IT IS FURTHER ORDERED that the parties must file a revised discovery plan and scheduling order in compliance with LR 26-1 by February 21, 2023.
