Filing 18 MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Daniel J. Albregts on 1/30/2023. Re: #17 Joint status report. The parties' joint status report explains that the parties are seeking a stay of discovery pending an anticipated motion to remand and forthcoming motions to dismiss. However, staying discovery pending the outcome of a dispositive motion requires the parties to demonstrate good cause. This Court follows the two-step, good cause analysis outlined in Scharder v. Wynn, No. 2:19-cv-02169-JCM-BNW, 2021 WL 4810324, at *4 (D. Nev. Oct. 14, 2021). That analysis provides that a Court may grant a stay of discovery when a dispositive motion is pending if: (1) the dispositive motion can be decided without further discovery; and (2) good cause exists to stay discovery. To the extent the parties seek to stay discovery, they must file either a motion or stipulation to stay discovery including facts sufficient for the Court to conduct its analysis regarding whether a stay is appropriate here.(no image attached) (Copies have been distributed pursuant to the NEF - KL) |
