Filing 15 MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Daniel J. Albregts on 4/27/2023. Re: #12 Stipulation to amend complaint. Having reviewed Plaintiff and Defendant CCSD's purported stipulation, the Court finds that it fails to comply with Local Rule 7-1(c). Under Local Rule 7-1(c), "[a] stipulation that has been signed by fewer than all the parties or their attorneys will be treated-and must be filed-as a joint motion." Here, only counsel for the Plaintiff and CCSD have signed the stipulation. Counsel for Defendant Billups has not. Additionally, because the stipulation should have been filed as a joint motion, Plaintiff and CCSD should have supported their request with points and authorities under Local Rule 7-2(a). Finally, Plaintiff and CCSD's amended complaint is filed improperly on the docket. Under Local Rule 15-1(a), "[u]nless the court orders otherwise, the moving party must attach the proposed amended pleading to a motion seeking leave of the court to file an amended pleading." LR 15-1(a) (emphasis added). IT IS THEREFORE ORDERED that the stipulation to amend complaint #12 is DENIED WITHOUT PREJUDICE. IT IS FURTHER ORDERED that Clerk of Court is kindly directed to STRIKE the amended complaint 13 under Local Rule IA 10-1(d) for its failure to conform to Local Rule 15-1(a).
