MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Daniel J. Albregts on 7/7/2023. Re: #10 Confidentiality stipulation. Having reviewed the parties' stipulation, the Court finds that it fails to cite the correct process and standard for filing confidential documents under seal. Specifically, paragraphs 3 and 10 provide for a method of filing sealed documents that does not comport with the Ninth Circuit's decisions in Kamakana v. City and County of Honolulu, 447 F.3d 1172 (9th Cir. 2006) and Ctr. for Auto Safety v. Chrysler Group, LLC, 809 F.3d 1092, 1097 (9th Cir. 2016) or Local Rule IA 10-5. While the parties reference these standards in paragraph 15, because paragraphs 3 and 10 are inconsistent with these standards, the Court denies the parties stipulation without prejudice and will require that any amended stipulation correct these paragraphs. IT IS THEREFORE ORDERED that the parties' stipulation #10 is DENIED WITHOUT PREJUDICE. (no image attached) (Copies have been distributed pursuant to the NEF - KL)
