| Filing 6 MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Daniel J. Albregts on 10/26/2023. Re: #5 Motion to Seal and #3 Motion for Copy of Docket. Plaintiff moves to seal "all exhibits." (ECF No. #5 ). But Plaintiff does not identify which exhibits he seeks to seal or explain why there is good cause or compelling reasons, as required by Ninth Circuit authority outlined below, to seal the documents at issue. Additionally, the Court has already required that the exhibits to Plaintiff's complaint remain sealed at this time. (ECF No. #4 ). So, to the extent Plaintiff seeks to seal those exhibits, his motion is moot. A party seeking to file a confidential document under seal must file a motion to seal and must comply with the Ninth Circuit's directives in Kamakana v. City and County of Honolulu, 447 F.3d 1172 (9th Cir. 2006) and Ctr. for Auto Safety v. Chrysler Group, LLC, 809 F.3d 1092 (9th Cir. 2016). A party seeking to seal judicial records attached to motions more than tangentially related to the merits of the case must meet the "compelling reasons" standard. See Kamakana, 447 F.3d at 1183; Ctr. for Auto Safety, 809 F.3d at 1101. For records attached to motions not more than tangentially related to the merits of the case, the "good cause" standard applies. See Ctr. for Auto Safety 809 F.3d 1101. IT IS THEREFORE ORDERED that Plaintiff's motion to seal #5 is DENIED. Plaintiff also moves for a copy of the docket. (ECF No. #3 ). The Court is not responsible for providing copies of court filings to litigants. 28 U.S.C. 1915. However, the Court will grant Plaintiff's motion as a one time courtesy. IT IS THEREFORE ORDERED that Plaintiff's motion for a copy of the docket #3 is GRANTED. The Clerk of Court is kindly directed to mail Plaintiff a copy of this minute order and of the docket in this case.
