IT IS HEREBY ORDERED that Defendant Greyhound Lines, Inc. show cause as to why the Court should not dismiss this action for failure to satisfy the diversity jurisdiction requirements set forth in 28 U.S.C. 1332. Though Defendant alleges $30,000.000 in medical specials, Defendant does not appear to allege how it is more likely than not that the amount in controversy, in the present case, exceeds $75,000.00. "Where it is not facially evident from the complaint that more than $75,000 is in controversy, the removing party must prove, by a preponderance of the evidence, that the amount in controversy meets the jurisdictional threshold." Matheson v. Progressive Specialty Ins. Co., 319 F.3d 1089, 1090 (9th Cir. 2003). As the removing party, Defendant carries the burden in demonstrating that the amount in controversy, in this specific case, exceeds $75,000.00. Accordingly, Defendant shall have until February 14, 2024, to file a brief, not to exceed ten pages, demonstrating that the Court has subject matter jurisdiction over this action.
