Filing 10 MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey on 4/26/2024 STRIKING non-compliant certificate of interested parties and ORDERING SUMMERLIN BASEBALL CLUB MEMBER, LLC, AND CLARK COUNTY LAS VEGAS STADIUM, LLC to show cause why this case should not be dismissed.Defendants SUMMERLIN BASEBALL CLUB MEMBER, LLC, AND CLARK COUNTY LAS VEGAS STADIUM, LLC removed this action to this court based on diversity jurisdiction. #1 However, the court cannot determine if complete diversity exists because SUMMERLIN BASEBALL CLUB MEMBER, LLC, AND CLARK COUNTY LAS VEGAS STADIUM, LLC have not identified the citizenship of each of their members. See Johnson v. Columbia Properties Anchorage, LP, 437 F.3d 894, 899 (9th Cir. 2006) (stating that "an LLC is a citizen of every state of which its owners/members are citizens"). And while these defendants filed a certificate of interested parties, that certificate #4 violates recently amended FRCP 7.1, which (since 2022) requires that all parties in a diversity-jurisdiction case like this one identify the citizenship of "every individual or entity whose citizenship is attributed to that party." For an LLC, that means disclosing each and every member of the LLC. IT IS THEREFORE ORDERED that SUMMERLIN BASEBALL CLUB MEMBER, LLC, AND CLARK COUNTY LAS VEGAS STADIUM, LLC must show cause, in writing, by May 6, 2024, why this action should not be dismissed for lack of subject matter jurisdiction. Failure to timely respond to this order will result in the case being dismissed without prejudice.IT IS FURTHER ORDERED that SUMMERLIN BASEBALL CLUB MEMBER, LLC, AND CLARK COUNTY LAS VEGAS STADIUM, LLC's certificate of interested parties #4 is STRUCK for failure to comply with Federal Rule of Civil Procedure 7.1(a)(2). The defendants must file a corrected certificate of interested parties by May 6, 2024. (no image attached) (Copies have been distributed pursuant to the NEF - JAD) |
