April 16, 2024 Opinion or Order Filing 8 ORDER. Accordingly, IT IS HEREBY ORDERED that Plaintiffs Application to Proceed in forma pauperis ECF No. #6 will be held by the Court at this time. IT IS FURTHER ORDERED that Plaintiffs Application to Proceed in forma pauperis ECF No. #4 is DENIED as moot. IT IS FURTHER ORDERED that Plaintiff must submit a completed Financial Certificate (attached hereto as Exhibit 2) signed by the Florence McClure Womens Correctional Center and by Plaintiff, together with a printout of her trust fund account statement (example attached as Exhibit 1) for the last six months (or, if Plaintiff has not been at the facility for six months, for the period of time she has been housed at the FMWCC), no later than May 25, 2024. IT IS FURTHER ORDERED that Plaintiffs Motion seeking appointment of counsel ECF No. #7 is DENIED. IT IS FURTHER ORDERED that if Plaintiff fails to file the completed Financial Certificate and print out of her trust fund account statement by or before May 25, 2024, the Court will recommend this case be dismissed without prejudice as Plaintiff will have had three opportunities to submit a complete application to proceed in forma pauperis. A dismissal without prejudice allows Plaintiff to commence a new claim, with a complete in forma pauperis application and complaint, when she is able to do so. Signed by Magistrate Judge Elayna J. March 11, 2024 Opinion or Order Filing 3 ORDER denying #1 Motion/Application for Leave to Proceed in forma pauperis without Prejudice. IT IS FURTHER ORDERED that on or before May 10, 2024, Plaintiff must either pay the $405 filing fee for a civil action1 or file with the Court: (1) a complete Application to Proceed in Forma Pauperis for Inmate on the Courts approved form; (2) a Financial Certificate properly signed by both the inmate and a prison or jail official; and (3) a copy of the inmates prison or jail trust fund account statement for the previous six-month period. IT IS FURTHER ORDERED that failure to either pay the $405 filing fee or file a complete application to proceed in forma pauperis on or before May 10, 2024, will result in a recommendation to dismiss this action without prejudice. A dismissal without prejudice allows Plaintiff to file her case with the Court, under a new case number, when she is able to comply with LSR 2-1 and file a complete application to proceed in forma pauperis or pay the required filing fee. IT IS FURTHER ORDERED that the Court will retain Plaintiffs Complaint #1 -1 but will not file it at this time. IT IS FURTHER ORDERED that the Clerk of the Court must send Plaintiff the approved form application to proceed in forma pauperis for inmate along with the information and instructions for filing the same.
