I THEREFORE ORDERED that by July 12, 2024, the Attorney General's Office shall advise the court whether it will enter a limited notice of appearance on behalf of the defendants only for purposes of responding to the motion for temporary restraining order. Additionally, based on the nature of the allegations, the defendants shall also until July 12, 2024 to file its substantive response to Johnson's motion for temporary restraining order (ECF No. #3 ). I FURTHER ORDER that if Johnson chooses to file a reply, he must do so within 7 days after the defendants file a response. I FURTHER ORDER the clerk of the court to electronically serve a copy of this order and a copy of Johnson's motion for temporary restraining order (ECF No. #3 ) on the Office of the Attorney General of the State of Nevada, by adding the Attorney General of the State of Nevada to the docket sheet. Filing 4 ORDER. It is therefore ordered that Plaintiff has until August 19, 2024, to either pay the full $405 filing fee or file a fully complete application to proceed in forma pauperis with all three required documents: (1) a completed application with the inmate's two signatures on page 3, (2) a completed financial certificate that is signed both by the inmate and the prison or jail official, and (3) a copy of the inmate's trust fund account statement for the previous six-month period. It is further ordered that if Plaintiff is not able to obtain his financial certificate and inmate account statement from prison officials, Plaintiff shall file the first three pages of the application to proceed in forma pauperis together with a declaration detailing the efforts he took to acquire the financial certificate and inmate account statement from prison officials. Plaintiff is cautioned that this action will be subject to dismissal without prejudice if Plaintiff fails to timely comply with this order. A dismissal without prejudice allows Plaintiff to refile the case with the Court, under a new case number, when Plaintiff can file a complete application to proceed in forma pauperis or pay the required filing fee. The Clerk of the Court is directed to send Plaintiff Nicholas Johnson the approved form application to proceed in forma pauperis for an inmate and instructions for the same and retain the complaint (ECF No. #1 -1) but not file it at this time.
