Pending before the Court is Defendants Sherry and Norman Zwagil's Motion to Quash Service of Process. ECF No. #11 . The Court reviewed the Motion, the Opposition (ECF No. #12 ), and the Reply (ECF No. #13 ). The parties maintain the instant Motion and Opposition despite Plaintiff stating that, irrespective of the issue of the contested service on the Zwagils at their home, a waiver of service would be sent to the Zwagils under Federal Rule of Civil Procedure 4(d). Accordingly, IT IS HEREBY ORDERED that if the issue presented in the instant Motion is not resolved by or before twelve noon (12:00 p.m.) on August 12, 2024, the parties, through their counsel, must appear in person on August 12, 2024 at 2:30 p.m. in LV Courtroom 3D at the United States District Court for the District of Nevada. IT IS FURTHER ORDERED that if this matter is resolved, the Zwagils must file a Notice of Withdrawal of their Motion to Quash Service (ECF No. #11 ) by or before August 12, 2024 at 12 noon.
