January 29, 2009 Opinion or Order Filing 11 ORDER granting in part and denying in part 9 respondents' Motion to Dismiss. The court finds that grounds 1(b), 2, 4, and 5 are unexhausted. IT IS FURTHER ORDERED that no later than 02/23/2009, petitioner shall do one of the following: 1) f ile & serve a Notice of Abandonment of Claims, stating that he wishes to abandon grounds 1(b), 2, 4, and 5, and proceed only on grounds 1(a), 1(c) & 3; or 2) file & serve a motion for stay, requesting a stay of this action, & attempting to make the r equired showing for such a stay, pursuant to Rhines v Weber, 544 U.S. 269 (2005), so that he may return to state court & exhaust his unexhausted claims. IT IS FURTHER ORDERED that if petitioner files & serves a motion for stay, respondents shall hav e 30 days to respond to such motion & petitioner shall thereafter have 30 days to reply. IT IS FURTHER ORDERED that if petitioner files & serves a notice of abandonment of claims, respondents shall have 30 days to file an answer, responding to grounds 1(a), 1(c) and 3, & petitioner shall thereafter have 30 days to file a reply.
