Filing 20 MINUTE ORDER IN CHAMBERS of the Honorable Judge Edward C. Reed, Jr, on 3/10/2009. IT IS HEREBY ORDERED that P's 10 Motion for Declaratory Judgment is DENIED. FURTHER ORD that P's 14 Motion to Amend is GRANTED, pursuant to Fed. R. Civ . P. 15(a)(1)(A). FURTHER ORD that Ds' 11 Motion to Dismiss is GRANTED on the following basis: the 11 Motion to Dismiss will be treated as addressed to Ps' 14 First Amended Complaint. Though the standard for granting leave to amend is very liberal, it is apparent that granting P further leave to amend here would be futile. Thus, P's 14 First Amended Complaint is dismissed, and leave to amend is denied. The Clerk shall enter judgment accordingly.
