ORDER: IT IS ORDERED that petitioner's 1 Motion/Application for Leave to Proceed in forma pauperis is GRANTED , petitioner will not be required to pay the $5.00 filing fee. The Clerk shall file the petition but shall withhold ser vice at this time. FURTHER ORDERED that, within 30 days from entry of this order, petitioner shall show cause why the petition should not be dismissed with prejudice as time-barred; and, why the petition should not be dismissed without prejudice for lack of exhaustion. Petitioner shall file, with his show cause response, a copy of his filings in the state courts upon which he bases his contention that he exhausted his claims in the state courts together with with copies of all state court deci sions regarding his conviction of sentence. The Clerk shall file a copy of the Nevada Supreme April 15, 2009, order of affirmance. The Clerk shall add AG Catherine Cortez Masto as counsel for respondents. The Clerk shall send a copy of the petitio n, the exhibit attached, and the Nevada Supreme Court order to petitioner along with a copy of this order. (sent: 08/17/09).
