ORDER. IT IS ORDERED that the 2 Motion to Remand is DENIED. FURTHER ORDERED that the 12 Motion to Dismiss is GRANTED IN PART AND DENIED IN PART. All claims are dismissed except that for statutorily defective foreclosure. FURTHER ORDER ED that defendants will not transfer the Property or take any action to evict plaintiff or his tenants, if any, for one hundred (100) days. During this period, plaintiff wi11 make full, regular monthly payments under the note every thirty(30) days, with the first payment due 04/1/2011. FURTHER ORDERED that during the injunction period, the parties will engage in the state Foreclosured Mediation Program or private mediation. Signed by Judge Robert C. Jones on 3/24/2011.
