ORDER DENYING # 7 Motion to Remand.FURTHER ORD the # 12 Motion to Dismiss and the # 17 Motion for Summary Judgment are GRANTED in part and DENIED in part. All claims are dismissed except that for statutorily defective foreclosure. IT IS FURTHER O RDERED that Ds will not transfer the Property or take any action to evict P or his tenants, if any, from the Property for 100 days. During this period, P will make full, regular monthly payments under the note every 30 days, with the first payment du e April 1, 2011. IT IS FURTHER ORDERED that during the injunction period the parties will engage in the state Foreclosure Mediation Program, if available. If not available, Ds will conduct a private mediation with P in good faith.
