March 9, 2012 Opinion or Order Filing 25 ORDER. The Clerk shall issue a summons for Dr. Kent Robinson andsend the same to the U.S. Marshal with the address provided 21 23 . The Clerk shall send to plaintiff one USM-285 form, one copy of the complaint 5 , and one copy of this order for the defendant (SENT). Plaintiff shall have thirty (30) days to complete the USM-285 service form and return it along with the other documents to the U.S. Marshal for service. IT IS ORDERED that plaintiff's 1 Motion/Application for Leave to Proceed in forma pauperis is GRANTED, plaintiff shall not be required to pay an initial installment filing fee. The NDOC shall pay to the Clerk 20% of the preceding month's deposits to plaintiff (#68549) in the months that exceeds $10.00 until the full $350.00 filing fee has been paid. The Clerk shall SEND a copy of this Order to the Finance Division and to Chief of Inmate Services for the NDOC (SENT). The Clerk shall electronically serve a copy of this Order and a copy of plaintiff's complaint 5 to the Office of the Attorney General. The Attorney General advise the Court within twenty-one (21) days whether it can accept service fo r the named defendants. As to any of the named defendants for which the Attorney General cannot accept service, the Office shall file, under seal, the last known address(es) of defendants. If service cannot be accepted for any defendants, plaintiff shall file a motion identifying the defendant(s) requesting issuance of summons. If the Attorney General accepts service, defendant(s) shall file an answer/response to the complaint within sixty (60) days. Plaintiff shall serve defendants a copy of all pleadings.
