Crtrm Administrator: Peggie Vannozzi; Pla Counsel: Shauna Martin Ehlert; Def Counsel: Victor Perry; Court Reporter/Recorder: Kathy French< /I>; Time of Hearing: 1:30 PM - 2:45 PM; Courtroom: 5; The Court advises counsel that it has reviewed Plaintiff/Counter Defendant's Motion to Dismiss Counterclaims (ECF No. 31 ), the response (ECF No. 33 ), and the rep ly (ECF No. 36 .) The Court has also reviewed Defendant/Counter Claimants' motion to stay (ECF No. 38 ,) the response (ECF No. 42 ) and the reply (ECF No. 43 .) The Court makes counsel aware that the Clerk's office conducted a routine case review of the newly opened 3:16-cv-418-MMD-VPC and discovered that Exhibits 1 and 3 to Plaintiff's complaint (ECF No. 1 ) contained personal information and so sealed attachments 1 and 3 to the Complaint. The Court takes judicial notice t hat it granted Plaintiff's motion to seal attachments 1 and 3 (ECF No. 23 ) in this case and in 2:16-cv-1630, ECF No. 5, after the Clerk's Office had transferred the case to Reno and assigned the case number 3:16-cv-418. The Court directs the courtroom administrator to attach a copy of the internal docket sheet to this minute order as an exhibit to this hearing which shows that the Clerk's Office staff sealed the attachments. Ms. Ehlert and Mr. Perry present argument on the motions. The Court makes findings for the record and advises the parties that the Court will issue an oral ruling. For the reasons the Court has placed on the record, Plaintiff's motion to Dismiss the counterclaims (ECF No. 31 ) is granted and the counterclaims are dismissed with prejudice. For the reasons placed on the record, Defendant's Motion to stay (ECF No. 38 ) is denied in part and granted in part. The Court stays all depositions in this matter pending the jury verdict in 3:16-cr-29-MMD-WGC. The Court may revisit this issue if the 7/25/2017 jury trial is continued. Written discovery may be propounded, and Defendant Rand may assert his 5th Amendment rights in conjunction with the written discovery re quests. The Court encourages the parties to prepare a proposed protective order for Magistrate Judge Cooke to review. The Court directs counsel to schedule a case management conference with Magistrate Judge Cooke. (Copies have been distributed pursuant to the NEF - PAV) |
