Filing 127 ORDERED that Plaintiff's motion for summary judgment (ECF No. 103 ) is granted as to its quiet title/declaratory judgment claim. The Court declares that the HOA Sale did not extinguish Plaintiff's DOT and thus SFRs interest in t he Property is subject to the DOT. It is further ordered that Plaintiff's remaining claims, which are alleged in the alternative, are dismissed as moot. It is further ordered that the HOA's motion for summary judgment (EC F No. 102) is denied. It is further ordered that Plaintiff's Rule 56(d) Motion (ECF No. 115) is denied as moot. The Clerk of Court is directed to enter judgment in Plaintiff's favor accordingly, including on SFRs remaining counterclaim against Plaintiff (ECF No. 27 at 16-19), and close this case.
