February 26, 2021 Opinion or Order Filing 8 ORDER - Within 14 days of the date of this Order (3/12/2021), the Attorney General's Office shall advise the court whether it will enter a limited notice of appearance on behalf of Defendants, and if so, also within 14 days of the date of this Order, the Attorney General's Office shall file a response to Plaintiff's motion for preliminary injunction (ECF No. #6 ). The Clerk of the Court shall electronically serve a copy of this Order, a copy of Plaintiff's FAC (ECF No. #5 ), as well as a copy of Plaintiff's motion for a preliminary injunction (ECF No. #6 ) on the Nevada Attorney General's Office by adding the Nevada Attorney General's Office to the docket sheet. February 26, 2021 Opinion or Order Filing 7 SCREENING ORDER - Plaintiff's First Amended Complaint (ECF No. #5 ) is the operative complaint in this action. Plaintiff's first application to proceed in forma pauperis (ECF No. #1 ) is denied as moot, and Plaintiff's second application to proceed in forma pauperis (ECF No. #4 ) is the operative application in this action. A decision on Plaintiff's operative application to proceed in forma pauperis (ECF No. #4 ) is deferred. Plaintiff's Eighth Amendment claims for deliberate indifference to serious medical needs may proceed against Carpenter and Minev. This action is stayed for 90 days (5/27/2021) to allow the parties an opportunity to settle. On or before 90 days from the date this order is entered, AG must file the 90-day stay report form. If the case does not settle, Plaintiff will be required to pay the full $350.00 filing fee. Any "Motion to Exclude Case from Mediation" is due on or before 21 days from the date of this order. Clerk will electronically serve a copy of this order and Plaintiff's First Amended Complaint (ECF No. #5 ) on AG (electronic service on 2/26/2021). AG must advise the Court within 21 days of the date of the entry of this order whether it will enter a limited notice of appearance on behalf of Defendants for the purpose of settlement.
