Filing 4 ORDER - Magistrate Judge Denney's Report and Recommendation (ECF No. #3 ) is ADOPTED and ACCEPTED. Plaintiff's In Forma Pauperis application (ECF No. #1 ) is GRANTED. Within 30 days Plaintiff must pay, through his institution, an initial partial filing fee in the amount of $10. Thereafter, whenever Plaintiff's prison account exceeds $10, he is required to make monthly payments in the amount of 20 percent of the preceding month's income credited to his account until the full $350 filing fee is paid. The Clerk of the Court shall file Plaintiff's Complaint (ECF No. #1 -1). The Complaint (ECF No. #1 -1) is DISMISSED WITH PREJUDICE.
