ORDER - It is therefore ordered that this action is dismissed without prejudice. If Grim wishes to pursue his claims, he must file a new cause of action in a new proceeding. It is further ordered that Grim's application to proceed in forma pauperis (ECF No. #1 ) is denied as moot. It is further ordered that a certificate of appealability is denied, as jurists of reason would not find the dismissal of this action to be debatable or wrong. The Clerk of Court is directed to enter judgment accordingly and close this case. The Clerk of Court is further directed to send Grim the form for a civil rights complaint under 42 U.S.C. 1983.
