Filing 21 ORDER SETTING INMATE EARLY MEDIATION CONFERENCE. An Inmate Early Mediation Conference is set forTUESDAY, FEBRUARY 28, 2023, at 1:00 p.m., via video conference before Mediator LYDIA NUSSBAUM. Plaintiff will appear and participate in the mediation through video conferencing. In the case of an in-custody plaintiff, defense counsel will make the necessary arrangements for Plaintiff to appear by video conference and must provide Ashlyn Bye at Ashlyn_Bye@nvd.uscourts.gov with the video conference reservation number and the dial-in information where Plaintiff can be reached at least two days prior to the mediation. Defense counsel must contact Plaintiff by telephone in advance of the mediation to meet and confer about the mediation process and settlement options. The parties' mediation statements must be received by the court at the following email address: InmateMediationBrief@nvd.uscourts.gov no later than 4:00 p.m., on TUESDAY, FEBRUARY 14, 2023. Defense counsel must email Ashlyn Bye at Ashlyn_Bye@nvd.uscourts.gov and provide the email addresses for each participant for the defense who will appear at the mediation no later than 4:00 p.m. on TUESDAY, FEBURARY 14, 2023. Filing 9 ORDER - Plaintiff's motion at ECF No. #8 is GRANTED insofar as the court will permit ECF No. #8 to serve as Plaintiff's supplement to the motions at ECF Nos. #3 , #4 , and #5 . Within 14 days of the date of this Order (12/23/2022), the Attorney General's Office shall advise the court whether it will enter a limited notice of appearance on behalf of Defendants for the purpose of responding to Plaintiffs motion for preliminary injunction and temporary restraining order and supplement, as well as his request for a telephonic or video conference. If the Attorney General's Office is willing to enter a limited notice of appearance, then also within 14 days of the date of this Order (12/23/2022), the Attorney Generals Office shall file a response to Plaintiff's motion and supplement as well as his motion for a telephonic or video conference. Plaintiff will have seven days from the date he receives the response to file a reply brief. The court will then determine whether to hold a hearing or issue a report and recommendation. The Clerk of Court shall electronically serve a copy of this Order, a copy of Plaintiff's complaint (ECF No. #7 ), a copy of the order screening the complaint (ECF No. #6 ), as well as a copy of Plaintiff's motion for preliminary injunction and temporary restraining order (ECF Nos. #3 , #4 ), emergency motion for telephonic or video conference (ECF No. #5 ), and supplement (ECF No. #8 ) on the Nevada Attorney General's Office by adding the Nevada Attorney Generals Office to the docket sheet. Filing 6 SCREENING ORDER - It is therefore ordered that a decision on the application to proceed in forma pauperis (ECF No. #1 ) is deferred. It is further ordered that the Clerk of the Court file Plaintiff's complaint (ECF No. #1 -1) and send Plaintiff a courtesy copy of the complaint. The Clerk of the Court will add Drummond and Kicklord as Defendants in this case. Claims will proceed or are dismissed as detailed herein. Defendants Hernandez and Hollingsworth are dismissed from the entirety of the case without prejudice. The Court will address Plaintiff's motions for a preliminary injunction and a hearing (ECF Nos. #3 , #4 , #5 ) in a separate order. This action is stayed for 90 days to permit parties to settle. (90-day stay report due 3/2/2023.) If case does not settle Plaintiff will be required to pay the full $350 statutory filing fee plus the $52 administrative filing fee for a total of $402. If Plaintiff needs an interpreter to participate in the mediation program, Plaintiff will file a notice identifying the interpretation language and the need for the interpreter within 30 days from the date of this order (1/3/2023). Clerk shall e-serve AG this order and copy of the Complaint, by adding NDOC to the docket sheet as an interested party (E-service 12/2/2022; Complaint upon subsequent filing).
